The US is regarded as the world’s most ethnically integrated democratic country.
Nevertheless, its financial gains have not been evenly distributed all over the community, as
entire American societies have become marginalised. One fundamental element of this
marginalisation is the discriminatory treatment of people of colour that happens gradually all
over the criminal justice system of the US. Ethnic and racial disparities contribute to
community mistrust of the criminal justice system, limiting its potential to promote the
security of the public. Numerous individuals in the criminal justice system are keenly
informed of racial disparity and want to do something about it (“Mental Health Act”, 2022).
Numerous researchers fully admit that racial difference indicates societal problems, but they
believe that initiatives can decrease disparity. Racial disparities persist in the criminal justice
system when an ethnic or racial group under the system’s regulation exceeds the percentage
of such groups in the overall populace. Such disparities vary and can involve varying levels
of criminal behaviour, the focus of law enforcement on specific societies, legislative policies,
or making determinations by criminal justice professionals who have complete discretion in
the judicial procedure at one or more phases of the system (Hetey & Eberhardt, 2018 ).
Disparate treatment among equally qualified individuals due to race and ethnicity results
in unlawful or unjustified racial differences in the criminal justice system. In certain instances,
this may be because of blatant ethnic bias. In contrast, it may be because of the impact of
variables that are only partially connected to race and ethnicity in others. Besides, inequalities
result from impulsive, personal or institutional-level judgements based on race and ethnicity.
Structural prejudice, which originates from long-standing disparities in the treatment of those
strongly associated with race (such as poverty), can also cause or exacerbate racial disparities.
Racial disparities are pervasive in the criminal justice system. Their persistence threatens to
undermine the concept that the US’s criminal justice system is reasonable, efficient, and just
(Comer, 2018 ). In order to be perceived as reasonable, the criminal justice system requires

the majority’s support and assistance. The perspective or incidence of racial prejudice or
unfair ethnic differences deteriorates public faith in the system, affecting public safety
consequences. Due to the high rates of minority participation in the system represent a
complicated range of social, financial, and civic concerns; thus, criminal justice practitioners
failed to eradicate all imbalances from the system on their own. Criminal justice professionals
may notice themselves as being in the awful situation of fixing racial disparities over which
they have slight oversight (“ACA Code of Ethics”, 2014).
